TERMS OF SERVICE

PILATES EVOLUTION LLC

Please note our Terms of Service are subject to change or update at any time, at the sole discretion of Pilates Evolution (the “Studio”).  Continued use of the Studio and its services is contingent on acceptance of any changes or updates to this policy.  If you are an existing customer and do not agree to a policy change or update, please reach out to Pilates Evolution at info@pilatesevolutionllc.com.


 

GENERAL TERMS

  1. Client agrees to the terms of the Liability Waiver and Release.

  2. All services, classes, packages, and memberships must be secured via available payment methods prior to service on the pilatesevolutionmarin.com website, unless otherwise mutually arranged by the Client and Pilates Evolution.

  3. All regularly scheduled classes and private sessions will be approximately 50 minutes, but may run several minutes longer or shorter.

  4. Classes may be booked up to 2 weeks in advance.

  5. Classes may be booked up to 30 minutes prior to start.  Clients may still attend class if they fail to register within the sign up window if there is space available when they arrive, but will need to register manually with the instructor as a drop in.  Membership and plan credits may still be used.

  6. 12 hr notice is required for cancellation and/or rescheduling for all classes and services.

  7. Booked class or private session reservations that the client does not attend and are not canceled or rescheduled according to the Terms of Service will not be refunded or credited back to the clients account.

  8. Client agrees to arrive to classes on time.  Late arrival can be very detrimental to the flow of the class for other students.  Clients arriving excessively late may be asked to wait until an appropriate time to join the class when disruptions will be minimized.

  9. Classes that are fully booked in advance may have a waitlist available.

  10. If Client receives notice of an open reservation available off the waitlist, Client will have 1 hour to accept the reservation.  Following booking off the waitlist, all other terms of service apply to that reservation.

  11. If Client has not successfully booked a class prior to arrival, they may be manually added to the class by the Studio, and this class will either be deducted from the Client’s package or plan, or paid for by the client in person via point-of-sale payments methods available, such as cash or credit card.

  12. Classes are limited to clients 16 years of age and older.  Clients under the age of 18 will require written parent/guardian approval and liability waiver prior to service.

  13. Pilates Evolution may assign a substitute instructor for any class or service.

  14. Pilates Evolution and its instructors reserve the right to refuse service to any client.

  15. Clients who are new to Pilates or have very limited experience are strongly encouraged to attend a private session prior to attending their first class. 

  16. Pilates Evolution and its instructors may refuse service to a client who is at risk for injury based on inexperience with the equipment and its use.

  17. Client agrees to provide to the Studio any pertinent health and/or injury information that may be relevant to services provided.

  18. Client agrees to not attend any class or other service when ill, contagious, symptomatic, or recently exposed to any contagious illness.

  19. All classes, private sessions, and services are subject to cancellation by Pilates Evolution for any reason.  Classes that have no bookings 2 hours prior to start are likely to be canceled by the Studio.

  20. Clients will be given a credit for any class or service canceled, according to these Terms of Service, whether by the Studio or the Client, to be used on the pilatesevolutionmarin.com website.  If the class was booked via a single purchase, rather than by making use of a package or plan, then the client may be issued a refund instead by request, to the original payment method, by requesting the refund via email at info@pilatesevolutionllc.com .


 

STUDIO POLICIES

  1. Shoes must be removed prior to entering the workout area in the studio.  

  2. Storage is provided in the waiting area of the studio for shoes and other personal belongings.  Pilates Evolution assumes no responsibility for lost or stolen items.

  3. Clean grip socks must be worn in the studio space at all times.  If Client does not have clean grip socks when they arrive, they are available for purchase in the Studio.

  4. Absolutely no shoes may be worn on any equipment in the studio at any time.

  5. No unattended children under 16 years old in the studio.

  6. No cell phone use in the studio.

  7. No pets in the studio.

  8. Client agrees to arrive at the studio without excessive perfume, cologne, or fragrance.

  9. Client will promptly exit the studio space following service completion to allow for transition to the next scheduled service.

  10. Clients awaiting class or service in the waiting area agree to do so quietly and otherwise not disturb any class or service currently in progress.



 

PACKAGE TERMS (10 Pack, 3 Packs, etc…)

  1. Packages begin on the date of purchase and specify a number of credits to be used for the booking of classes or sessions during the following 6 month term.  The package expires 6 months later, on the same day of the month as purchase date.

  2. Each credit is valid for a single class or session, depending on the plan purchased, for the client only, and can be redeemed on the pilatesevolutionmarin.com website for use in the Pilates Evolution studio located at 247 Shoreline Highway, Mill Valley, CA 94941.

  3. Credits that are unused at the end of the term of the package expire and will not be retained for future use by the client.

  4. Canceled bookings will be credited back to the Client’s Package.



 

MONTHLY PLAN TERMS

  1. Monthly Plans begin on the date of purchase, or at a date mutually agreed upon by the Monthly Plan Client (“Member”) and Pilates Evolution LLC (the “Studio”), and specify a number of credits to be used for the booking of classes or private sessions during the month  

  2. Each credit is valid for a single class or private session, depending on the plan purchased, for the Member only, and can be redeemed on the pilatesevolutionmarin.com website for use in the Pilates Evolution studio located at 247 Shoreline Highway, Mill Valley, CA 94941.

  3. Credits reset each month on the renewal date to the original number of credits specified in the plan.  Members will not retain any unused credits from a previous month after the plan renews the following month.

  4. Monthly plans automatically renew on the same calendar day of each month thereafter.

  5. Monthly plan Members agree to provide autopay information to Pilates Evolution to fund the automatic renewal.  Member also agrees that Pilates Evolution LLC is authorized to charge the specified recurring Monthly Plan membership fees to the credit card or other payment method on file for Autopay on a recurring monthly basis until canceled.

  6. Members may put their Monthly Plan on hold if they will be gone for an extended period of time.  The hold may be between 10 days and 30 days.  The member will not incur any charges while their membership is on hold, but also may not make any new bookings from their monthly plan during the hold period.  Please email membership@pilatesevolutionllc.com to request a hold.  

  7. Members may purchase additional classes or private sessions, at the same per class rate, as defined by (Monthly Plan price) / (# of classes per month), in the case that they use all of their monthly plan credits and wish to attend additional classes or sessions in that monthly cycle.  Members wishing to purchase additional classes or sessions must request a unique discount code from Pilates Evolution, either by email or phone, to be used on the website for single classes at checkout.

  8. Members are entitled to a 15% discount on all merchandise purchased at the Studio.

  9. Members are entitled to a 15% discount on any workshops or events held at the Studio.

  10. Once per monthly cycle, Members may request a guest pass for a free class, in the form of a discount code, for anyone that has not previously taken a class or private session at the Studio, to be used at the Studio when attending a class with the Member.  The guest will need to register for the class on pilatesevolutionmarin.com and use the discount code at checkout to receive the free class. 

  11. Monthly Plans may be canceled at any time.  No refunds will be given for any unused portion of a canceled Monthly Plan.
